Please read these Terms & Conditions ("Terms") carefully before using honey-peak.com or placing an order. By accessing our website, creating an account, or placing an order, you confirm that you are at least 18 years of age and that you agree to be bound by these Terms and by the policies they refer to. If you do not agree, do not use our website or buy our products.
IMPORTANT: SECTION 18 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. IT AFFECTS HOW DISPUTES ARE RESOLVED. YOU MAY OPT OUT WITHIN 30 DAYS AS EXPLAINED IN SECTION 18.

Honey Peak Commerce LLC is a Wyoming limited liability company. "Honey Peak", "we", "us" and "our" refer to Honey Peak Commerce LLC. "You" and "your" refer to the person using our website or buying our products.

2. ACCEPTANCE AND ELIGIBILITY
You must be at least 18 years old and able to enter into a legally binding contract to use our website or buy our products. By placing an order you confirm that you meet these requirements and that all information you provide is true, accurate and complete.
The following policies form part of these Terms and are incorporated by reference: our Purchase Options Cancellation Policy, Payment Policy, Refund & Return Policy, Shipping Policy, Privacy Policy and Medical Disclaimer. If any of those policies conflicts with these Terms, these Terms apply.
We may cancel any order, refuse service or close any account where we reasonably believe these requirements have not been met.

3. OUR PRODUCTS AND HEALTH INFORMATION
Honey Peak products are dietary supplements made with a raw honey base and botanical ingredients. They are sold for general wellness purposes only.
These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. They are not medicines and are not a substitute for medical care, prescribed medication or the advice of a qualified healthcare professional.
Nothing on our website, product pages, emails, social media, advertising or customer support communications is medical advice. All content is provided for general information only.
Individual results vary. Testimonials and reviews reflect the personal experience of individual customers. They are not typical, guaranteed or predictive results, and they are not a claim that the product will produce the same result for you.
The product label is the authoritative source for ingredients, directions and warnings. We make reasonable efforts to keep website information accurate, but if anything on our website differs from the label on the product you receive, follow the label. We may change formulations, packaging, sourcing or product descriptions at any time.

4. YOUR RESPONSIBILITY AND ASSUMPTION OF RISK
Before using our products you agree to:
- Read the full label, directions and warnings, and our Medical Disclaimer
- Consult your physician before use if you have any medical condition, take any prescription or over-the-counter medication, or are unsure whether the product is suitable for you
- Not use the product if you take nitrates, blood pressure medication or blood thinners, or have a heart condition, unless your physician has approved it
- Not use the product if you are allergic to honey, bee products or any listed ingredient
- Use the product only as directed and never exceed the recommended serving
- Stop use immediately and seek medical attention if you experience any adverse reaction
- Keep the product out of reach of children
You are solely responsible for deciding whether our products are appropriate for you and for any use of the products by you. To the fullest extent permitted by law, you voluntarily assume all risks associated with using our products, including use against the directions or warnings, use with medication or alcohol, and use without first consulting a physician.
Our products are for the personal use of the adult who purchased them. You must not give or resell them to anyone under 18 or to anyone you know has a condition listed in the warnings.

5. ORDERS AND CONTRACT
When you place an order, you make an offer to buy the selected products at the price shown at checkout. Your order confirmation email confirms that we received your order. A binding contract is formed when we confirm your order by email.
We may refuse, limit or cancel any order at our discretion, including for pricing or description errors, suspected fraud, unverified payment, stock unavailability, shipping restrictions, or orders that appear to be placed by resellers. If we cancel a paid order, we refund the full amount to your original payment method.
Orders placed before 10:00 PM Pacific Time on a business day begin processing that day. Orders placed after the cut-off, on weekends or on public holidays begin processing the next business day.

6. PRICING, TAXES AND PAYMENT
Prices are displayed in the currency shown at checkout. We may change prices at any time, but price changes do not affect orders we have already confirmed. Subscription price changes follow the notice rules in our Purchase Options Cancellation Policy.
If a product is listed at an incorrect price due to an error, we may cancel the order and refund you, even after confirmation.
United States: applicable state and local sales tax is calculated and added at checkout based on your shipping address.
Outside the United States: you are the importer of record and are responsible for all import duties, customs fees, VAT, GST, HST, brokerage fees and other charges imposed by your country, except where the law requires us to collect a tax at checkout. Full details are in our Shipping Policy.
Payment is processed by our third-party payment processors. By placing an order you authorize us to charge the full order amount, and any recurring subscription amounts, to your selected payment method. Full details are in our Payment Policy.

7. SUBSCRIPTIONS AND AUTOMATIC RENEWAL
Our products are sold as subscriptions. When you subscribe, your order renews automatically every 28 days at the price shown at checkout, plus applicable tax, and is charged to your payment method until you cancel.
You can cancel anytime, with no fee and no minimum commitment, in your member portal at honey-peak.com/pages/customer-portal or by emailing info@honey-peak.com. To avoid the next charge, cancel at least 48 hours before your renewal date.
By subscribing you give your express consent to these recurring charges. The full terms are in our Purchase Options Cancellation Policy, which forms part of these Terms.

8. PROMOTIONS, BUNDLES AND DISCOUNT CODES
Bundle offers (such as Buy 2 Get 1 Free or Buy 3 Get 2 Free), introductory prices and discount codes are subject to the terms shown with the offer and at checkout. Unless stated otherwise, offers cannot be combined, have no cash value, are limited to one per customer and household, and may be changed or withdrawn at any time without affecting orders already placed.
Free units in a bundle are part of that bundle. Returns and refunds of bundle orders are calculated as set out in our Refund & Return Policy.
We may cancel orders or recover discounts obtained through fraud, multiple accounts, code abuse or any breach of these Terms.

9. SHIPPING, TITLE AND RISK OF LOSS
Delivery times are estimates, not guarantees. Title and risk of loss pass to you when we hand the order to the carrier. This does not affect our commitment to replace or refund parcels confirmed lost in transit, as described in our Shipping Policy. We are not liable for delays caused by carriers, customs authorities, weather, incorrect addresses or other events outside our control.

10. RETURNS AND REFUNDS
Returns and refunds are governed by our Refund & Return Policy, including our 60-day return window for unopened products. Cancelling a subscription stops future charges and does not by itself refund past orders.

11. REVIEWS, TESTIMONIALS AND CONTENT YOU SUBMIT
If you submit a review, photo, video, comment or other content ("Content"), you confirm that it is your own honest opinion and experience, that you actually bought and used the product, and that it does not infringe anyone's rights.
You grant Honey Peak a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, display, edit for length and clarity, and distribute your Content in connection with our business, including in advertising, with attribution by first name and last initial or as you submitted it. We will not change the meaning of your Content.
If we offered you anything in return for a review (such as a discount, points or a free product), that fact may be disclosed alongside your review. We may remove any Content at our discretion. Reviews describe individual experiences and are not medical advice.

12. AFFILIATES AND ENDORSEMENTS
Some people who recommend Honey Peak are affiliates or creators who receive a commission, free product or other compensation. They are required to disclose that relationship clearly in every endorsement. Endorsers speak for themselves and not for Honey Peak, and they may not make health claims about our products. If you see an endorsement that breaks these rules, please tell us at info@honey-peak.com.

13. INTELLECTUAL PROPERTY
All content on honey-peak.com, including text, images, video, logos, product names, packaging designs, graphics and brand assets, is owned by or licensed to Honey Peak Commerce LLC and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify or use our content without our prior written permission. "Honey Peak" and our logo are our trademarks.

14. PROHIBITED USE
You agree not to:
- Use the website for any unlawful purpose
- Gain or attempt to gain unauthorized access to the website, our systems or other customers' accounts
- Submit false, misleading or fraudulent orders, information, reviews, returns or chargebacks
- Use bots, scrapers or automated tools to access or copy the website
- Damage, disable or impair the website or interfere with other users
- Resell, relabel or commercially distribute our products without our written authorization
We may suspend access, cancel orders and subscriptions, and refuse future orders for any breach of this section.

15. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, our website and products are provided "as is" and "as available". We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, other than those that cannot be excluded by law.
We do not warrant that our products will produce any specific result, that the website will be uninterrupted or error-free, or that the website is free of viruses or other harmful components.

16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Honey Peak Commerce LLC and its members, managers, employees, affiliates, suppliers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of our website or products, even if we were advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to these Terms, our website or our products will not exceed the amount you paid us for the product that gave rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

17. INDEMNIFICATION
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Honey Peak Commerce LLC and its members, managers, employees, affiliates and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your use of our products against the label directions or warnings; (c) your resale or provision of our products to any other person; or (d) Content you submit.

18. DISPUTE RESOLUTION, BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH INDIVIDUAL ARBITRATION AND LIMITS HOW YOU CAN SEEK RELIEF.
a. Informal resolution first. Before starting any arbitration or court case, you agree to send us a written notice at info@honey-peak.com describing your claim, the relief you want, and your name, email and order number. We will try to resolve it with you in good faith within 60 days. Most issues are solved this way within a day or two.
b. Agreement to arbitrate. If we cannot resolve a dispute informally, you and Honey Peak agree that any dispute, claim or controversy arising out of or relating to these Terms, our website, our products, any purchase or subscription, our marketing or our privacy practices (each a "Claim") will be resolved by binding individual arbitration, and not in court. This includes Claims about the scope or enforceability of this section.
c. Exceptions. Either party may bring an individual Claim in small claims court if it qualifies. Either party may seek relief in court for infringement or misuse of intellectual property.
d. Rules and location. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, before a single arbitrator. Arbitration may be held by video, by phone, or in the county where you live. We will pay the AAA filing, administration and arbitrator fees that exceed what you would pay to file a case in court, unless the arbitrator finds your Claim frivolous. The arbitrator may award the same individual relief a court could award.
e. CLASS ACTION AND JURY TRIAL WAIVER. YOU AND HONEY PEAK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND HONEY PEAK BOTH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate the claims of more than one person.
f. Mass filings. If 25 or more similar Claims are filed against us by or with the help of the same law firm or coordinated group, they will be administered in batches of up to 50 Claims, with one arbitrator per batch, and the AAA's Mass Arbitration Supplementary Rules will apply. Statutes of limitation are paused for Claims waiting in a batch.
g. Public injunctive relief. If you seek public injunctive relief that cannot be waived under applicable law, that request will be decided by a court after the individual arbitration is complete, and only to the extent required by law.
h. 30-day right to opt out. You may opt out of this arbitration agreement by emailing info@honey-peak.com within 30 days of your first purchase, with the subject "Arbitration Opt-Out" and your name, email and order number. Opting out does not affect any other part of these Terms.
i. Severability. If the class action waiver in paragraph (e) is found unenforceable for any Claim, that Claim must be brought in court, not in arbitration. If any other part of this section is found unenforceable, the rest remains in effect.
j. Time limit. To the extent permitted by law, any Claim must be brought within one year after it arises, or it is permanently barred.
k. Who this applies to. This section applies to customers in the United States. It does not apply where the law of your country or province prohibits pre-dispute arbitration or class action waivers for consumers.

19. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Section 18 is governed by the Federal Arbitration Act. For any Claim that is not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Wyoming, except where your local consumer law gives you the right to bring proceedings in your home courts.

20. CUSTOMERS OUTSIDE THE UNITED STATES
If you live in the United Kingdom, the European Union, Australia, New Zealand or Canada, you benefit from any mandatory consumer protection laws of your country or province. Nothing in these Terms removes or limits those rights.
Australia: our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those guarantees.
Canada: if you live in Québec or Ontario, the arbitration agreement and class action waiver in Section 18 do not apply to you to the extent your provincial consumer law prohibits them.
You are responsible for ensuring that our products may be lawfully imported into and used in your country.

21. ELECTRONIC COMMUNICATIONS AND SIGNATURES
You agree to receive notices, order confirmations, renewal reminders and other communications from us electronically, by email or through the website. Electronic communications satisfy any legal requirement that a communication be in writing. Your click to place an order and accept these Terms is your electronic signature.

22. EVENTS OUTSIDE OUR CONTROL
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including carrier or customs delays, natural disasters, epidemics, war, strikes, supplier failures, internet or payment system outages, or changes in law. If such an event affects your order, we will tell you and, where we cannot fulfil it, refund you.

24. THIRD-PARTY WEBSITES AND SERVICES
Our website may link to or use third-party services, such as payment processors, carriers and review platforms. We are not responsible for their content, terms or privacy practices. Your use of them is at your own risk and subject to their terms.

25. CHANGES TO THESE TERMS
We may update these Terms from time to time. The updated version takes effect when posted with a new "Last updated" date. Each order is governed by the Terms in effect when you placed it. For active subscriptions, we will email you about material changes at least 30 days before they apply to your next renewal, and you may cancel before then. Changes to Section 18 will not apply to Claims we already knew about before the change.

26. GENERAL
These Terms, together with the policies listed in Section 2, are the entire agreement between you and us about their subject matter. If any provision is found invalid, the rest remains in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or a successor business. Sections 3, 4 and 11 to 20 survive the end of your use of our website or any subscription. Headings are for convenience only. If these Terms are translated, the English version prevails.
